This privacy policy explains how SimplePOS (“we”, “us”) collects, uses, shares and protects personal data when you visit this website or use the SimplePOS point-of-sale service (the “Service”). If you have any question, email support@simplepos.business.

1. Who is responsible

For visitors of this website and for the people who hold a SimplePOS account (business owners and their staff), SimplePOS is the data controller.

Businesses that use the Service also store data about their own customers, suppliers and staff (for example a customer’s name and phone number on a sale). For that data the business is the controller and we act as its processor: we only handle it to provide the Service, on the business’s instructions. Requests about that data should go to the business you dealt with.

2. What we collect

  • Account details: your name, business name, email address, phone number, country, city and password (stored only as a secure hash).
  • Business data you enter: products, prices, stock, sales, purchases, expenses, customers, suppliers, staff and settings.
  • Enquiries: what you send through our contact, call-back, partner or referral forms.
  • Billing: your plan, invoices and payment references. Card details, if any, are handled by the payment provider and are not stored by us.
  • Technical and usage data: IP address, browser and device type, pages visited, approximate location (country and city derived from the IP address), the website that sent you, and sign-in and security logs.
  • Cookies and similar technologies: see section 6 and our Cookie policy.

3. How we use it

  • To create and run your account and provide the Service (performance of a contract).
  • To answer enquiries, give support and send service messages such as receipts, password resets, trial and renewal reminders.
  • To bill subscriptions and keep accounting records (legal obligation).
  • To keep the Service secure: prevent fraud and abuse, protect sign-ins (including CAPTCHA checks) and investigate incidents (legitimate interests).
  • To understand how the website is used and improve it, using our own privacy-friendly statistics (legitimate interests).
  • To send marketing about SimplePOS where the law allows or where you agreed. You can opt out at any time with the unsubscribe link or by replying STOP.

We do not sell personal data. We never use the business data you enter (your sales, stock or your customers’ details) for advertising.

4. Who we share it with

We share personal data only with service providers that help us run the Service, under contracts that require them to protect it, and only as far as needed:

  • Hosting and database providers (where the Service and your data are stored).
  • Email, SMS and WhatsApp delivery providers (to send the messages you or the Service send).
  • Payment providers (to collect subscription payments).
  • Tax-authority e-invoicing services, only if you switch on such an integration for your business.
  • Our authorised partners, when you signed up through a partner or chose a partner for local support.

We may also disclose data if the law requires it, to protect our rights or users’ safety, or as part of a merger or sale of the business (in which case this policy continues to apply).

5. International transfers

Our providers may process data in countries other than yours. Where the law requires it, we use appropriate safeguards such as standard contractual clauses.

6. Cookies

We use a small number of cookies and similar storage: essential ones (to keep you signed in and secure), preference ones (for example your website language) and, on public pages, statistics ones. Details and how to control them are in our Cookie policy.

7. Advertising (if enabled)

Our public website pages may show ads served by Google AdSense. No ads are shown inside the Service you sign in to.

  • Third-party vendors, including Google, use cookies to serve ads based on a user’s prior visits to this website or other websites.
  • Google’s use of advertising cookies enables it and its partners to serve ads to our users based on their visits to our sites and/or other sites on the Internet.
  • You may opt out of personalised advertising by visiting Google Ads Settings. You can also opt out of some third-party vendors’ use of cookies for personalised advertising at www.aboutads.info or, in Europe, www.youronlinechoices.eu.
  • Learn more about how Google uses information from sites that use its services.

Where the law requires consent (for example in the European Economic Area, the United Kingdom and Switzerland), ads are only personalised after you agree in the consent message shown to you; otherwise non-personalised ads are shown.

8. How long we keep data

  • Account and business data: while your account is active. After an account is closed we keep it for up to 90 days so it can be restored or exported, then delete or anonymise it, except backups which expire on their normal cycle.
  • Billing and accounting records: as long as tax and accounting laws require.
  • Enquiries and leads: up to 24 months after the last contact.
  • Website statistics: up to 13 months, in aggregated form after that.
  • Security logs: up to 12 months.

9. Security

We use encrypted connections (HTTPS), hashed passwords, encryption of stored secrets, role-based access, sign-in protection, activity logs and regular backups. No system is perfectly secure; if a breach affects your personal data we will tell you and the authorities where the law requires.

10. Your rights

Depending on where you live (for example under the GDPR in Europe, the UK GDPR, or laws such as the CCPA in California) you may have the right to access, correct, delete or export your personal data, to object to or restrict some uses, to withdraw consent, and to complain to a data-protection authority. You can exercise these rights by emailing support@simplepos.business. We will answer within the time the law sets (usually one month). We do not sell or “share” personal data for cross-context behavioural advertising as defined by the CCPA, other than the advertising cookies described in section 7, which you can refuse.

11. Children

The Service is for businesses and is not directed at children. We do not knowingly collect personal data from anyone under 16. If you believe a child has given us personal data, contact us and we will delete it.

12. Changes

We may update this policy. We will change the date at the top and, for important changes, tell account holders by email or in the app.
